Apple dragged to court for its flagship music player, the iPod has been blamed defective and could cause a loss of hearing. However, these allegations are not proven, Apple had won the case in court.

Previously, 2 residents sue California to the court that it pointed out that the iPod music player devices defective and unsafe. In addition, two men named Joseph Birdsong from Louisiana and Bruce Waggoner alleging that the iPod can cause someone to lose his hearing.

Birdsong and Waggoner said that the iPod can play music with 115dB loudness level and the potential users to use it in an unsafe level. However, quoted from News.com, Friday (1/1/2010), the court found that statement to mean that the user has the option to use the iPod within certain limits. This means it is not ipod defective.

Finally, Apple won the American courts because in this case there was no strong evidence that says that the music player device is not safe.

Confirmed also by the court that Apple has put a warning on each of its iPod devices that “permanent hearing loss may occur if earphones or headphones are used at high volume.”
